News Cop Shoots Unarmed Man In Head, Internal Investigation Never Completed, He Gets 10 Years in Jail.

27-year-old Paul Stewart was sentenced to 10 years in jail by Judge Michael Marcus this morning, while an investigation into the conduct of the police officer who shot the unarmed man in the head is yet to be completed 10 months after the incident took place.

In response to a blog post this morning, the cops’ Public Information Officer Brian Schmautz has laid out a lengthy justification for an officer shooting Stewart in the head last August. But Schmautz did not touch on the fact that the officer who shot Stewart, Stephanie Rabey, has continued to work without an investigation being completed into whether she was justified in pulling the trigger. Nor did Schmautz touch on District Attorney, Mike Schrunk’s justification for not holding a grand jury to see if Rabey was criminally liable for the shooting, that “no one was hurt,” despite the fact Stewart spent 8 hours in intensive care and had 2 brain scans to rule out a brain hemorrhage.

“The District Attorney would rather see me go convicted than go free,” said Stewart, at this afternoon’s sentencing hearing. “But I feel like the District Attorney is biased. You’ll convict me whether I’m guilty or not, but won’t let an officer who did a wrongful shooting go before a grand jury. That’s biased.

Stewart says he pled guilty on the advice of his defense attorney, but that he now regrets the decision and that he may well appeal the conviction. The District Attorney’s office pursued charges of unlawful possession of a firearm against him, even though the weapon was in the trunk of a car outside the house.

“I think the system is looking for a way to keep him quiet because as Judge Marcus said at least twice in open court, he was shot for no reason,” says Dan Handelman of activist group Copwatch. “So the best way to keep him quiet is to keep him locked up.”

“Regardless of whether he is innocent or guilty, in order for Stewart to pursue a complaint about excessive force, he needs to be free,” Handelman continues. “And now they’re going to see to it that he’s going to be locked up for ten years.”

Isn't it at least common courtesy to note what crime Mr. Stewart was sentenced for? Cops in this town are a bit crazy, but I'm guessing he didn't get 10 years just for having a fragment of bullet grazing his head.

I looked it up. About 50 counts of domestic violence, unlawful use of a weapon (against his GF, presumably), threatening, menacing... and then being a felon in possession of a weapon.

to me, this is more proof that Shrunk is a racist, which is long been said by a lot of his fellow-church goers, and was a deciding factor in PoPo's Scott McCollister's skate away from justice when he killed Kendra James. The subtext of your story seemed to be that the DA's office and the court were attempting to silence this guy by prosecuting him and putting him in jail for a long time. Dan Handleman said so, the subject said so. You seemed to endorse their view.

Now, if that is your angle (it is) how can you omit the important details of what he was convicted of? You can't. If it isn't important what he did, it isn't important that he was prosecuted, convicted, and sentenced to ten years, either.

Actually, he did NOT have 50 counts of anything against him, and wasn't guilty of some of the things he was accused of. As for the gun, it was NOT his, it was that female he lived withs gun. As for his employment status, he did have a job he was getting ready to start until she got him arrested. Well put I'm not a crook! This shouldn't apply to just police either. I once tried to shoot a gun that tried (successfully) to convince me that it had a gun. My first instinct was to question why a gun would need a gun, but then I decided just to play it safe and put it down. True story.

Matt, thank you for covering this story. I think this case brings up a variety of important issues. One issue is the Portland PDs actions over the years in regards to using lethal tactics against unarmed persons. The actions of Portland PD in this case are deeply concerning to me. I feel that Officer Rabey needs to answer some questions about what took place that morning in August. She works for a public department and I feel that if the "public" has questions about her actions, then they should be answered. I would like to know why she felt the need to shoot at the suspect when SERT was there. I could understand if she was the only officer on scene and felt threatened. But there were numerous officers present. It seems to me that she put other officers in danger by firing this shot. Why are the others there not questioning her actions? Anytime an officer shoots their gun, there should be a public hearing. Brian Schmautz describes the events that took place that morning and states that “At the time the officer shot Stewart, the officer stated she believed Stewart was reaching for a gun.” Mr. Stewart was in a second story apartment. The officers were looking at him through a window from the ground. How could have Officer Rabey see what he was reaching for? Those are just a few questions that I would like answered.

Another issue has to do with the high rate of people who re-offend after being locked up. Prison is an institution. People who spend time in prison become “institutionalized” or “prisonized”. I do believe that there are some people who can’t be rehabilitated. But the fact that the US has the most people in prison than any other country in the world should give us a clue that we aren’t doing something right.

Mr. Stewart has spent time in prison. Due to budget restraints, there were no programs in place to assist Mr. Stewart in his transition from prison back into society. No angry management, substance abuse or general counseling was offered to him. At the time of this last incident, Mr. Stewart was finding employment and had established a place of residency. He was trying the best he could to find his place back in society. However, a situation arose in which Mr. Stewart was not prepared to handle. He resorted to the way he has been programmed to deal with conflict, which is using violence or force. And the women who he was having conflict with knew this. I am not saying that she wasn’t a victim but it appears that BOTH of them played a part but Mr. Stewart is the one who is being excessively punished. Should he be sentenced for the crimes he committed that day? Yes. But 10 years is extremely excessive. Does this punishment really fit the crimes he committed? Is it worth tax payers’ money to keep him lock up that long? In my opinion, the answer is no.

I am hopeful that Portland PD and the DA will re-evaluate its investigation into this shooting and provide the public with some answers. As far as Mr. Stewart is concerned, I hope that he can appeal his case and get his sentence reduced. And society, I hope that we continue to question why we have so many people incarcerated and why our tax money is not being spent on programs to reduce these numbers.

How am I to feel safe in my own home even to the police when their job is TO PROTECT AND SERVE, not SHOOT to KILL and O shit I didn't kill the man so now RUN!! I agree that she took advantage of him being on parole. And she is familiar with how the system works and knew exactly what to say to get him arrested. She has lied numerous times and continues to do so. But at the same time he was aware that she is crazy and he choose to still messed with her. It is extremely important that these cases be brought out for public to know about. As citizens of the City of Portland and the State of Oregon, we have a right to know about these things.

In the last 10 years Officer Rabey has been involved in 2 separate "officer involved shootings". Once in December of 1998; and again in this case in August of 2007. It's my understanding that at the time of this incident in 2007, she had been a police officer for 13 years. 2 officer involved shootings in 13 years? Is she competing with fellow PPB Officer Scott McCollister? Officer McCollister has also had 2 separate FATAL officer involved shootings. (He shot and killed Kendra James in 2002 and Jason Spoor in 2008.) Let me see if I got this right: 2 Portland Police Bureau Officers, 4 armed victims of officer involved shootings, all within the last 10 years. Not to mention all the other victims of officer involved shootings or victims of police brutality and excessive force. These numbers are horrific. All of the above-mentioned victims of Officer Rabey and McCollister(Peter Gillbaugh, Kendra James and Paul Stewart) were unarmed except one(Jason Spoor).

These officers should accept responsibility, be held accountable, AND SHOW SOME REMORSE for their actions just like every other person is expected to do when they commit a crime.

I didn't "plead" guilty to anything. I was found guilty after a 5 day judge trial. I have never claimed to be completely innocent. However, I am NOT guilty of all the charges I was convicted of. I openly admitted my wrong doings in Court because I am a man that takes responsibility for my actions.

People are quick to judge a book by it's cover instead of by reading it's contents. Everything I have said from day one I can prove with actual facts and/or documentation that will be presented during appeals and PCR.

As for him being a retired cop, I think it's well known within the activist community that the PPA has long sought to modulate public opinion by having their rank 'n' file stooges to post commentary on all local boards, whether or not their individual remarks make any sense or not (which they usually don't) and this Old Duffer's postings are seen in that light. It's an over-used tactic known as "derailing the discourse" to seek to shift the focus away from what the commentary is suppose to be about with such senseless politicalization that it's readily apparent to those holding more than two-digited IQ's!
