Guffman... you sir are a total DOUCHE BAG!!! Don't you get that by informing the subjects, in this case, police officers, they are being recorded significantly alters their actions? It is the job of the camera to observe and record the actions of the subject and NOT to alter or interfere with the subjects natural actions. If the subject, again, in this case, police officers, are doing nothing wrong, and merely serving and protecting the public as is their job, then they should have nothing to fear at all from their actions, ie. job performance, being recorded by anyone, whether it be audio or video recordings! Police officers should be acting in accordance with the law at all times, whether there is a video or audio recording taking place or not! GET IT? GOT IT? GOOD!!! Ya big Douche...!!!

Patric Nolen is correct. As long as one is notified that he or she is being recorded with audio, the statute is met. The recorded person/s do not have to give their permission to do so.

all you have to do is "specifically inform" the people they are being recorded... so I would assume "excuse me, I am recording audio as well as video of this conversation." would work.

"(c) Obtain or attempt to obtain the whole or any part of a conversation by means of any device, contrivance, machine or apparatus, whether electrical, mechanical, manual or otherwise, if not all participants in the conversation are specifically informed that their conversation is being obtained."
No, subsection (2)(a)(A) exempts "Officers, employees or agents of a telecommunication or radio communication company who perform the acts prohibited by subsection (1)(a), (b) and (c) of this section for the purpose of construction, maintenance or conducting of their telecommunication or radio communication service, facilities or equipment." That looks like the media loophole. Anybody with a website is "conducting... their telecommunication or radio communication service" by posting cop-videos. Or am I missing something?

Good luck to the court challenge, but it looks like the law needs to be changed, as it bans any recording of conversations without the permission of those being recorded, unless the person doing the recording is a police officer. Any video recording of public events, including those by news organizations, which include sound, appear to be illegal under Oregon law.

It's too bad that this law is not enforced to protect the public, but to protect law enforcement personnel from oversight by the citizenry.
